In compliance with current regulations, the entity SUNSET BEACH CLUB, S.A. that operates on the internet from this website www.sunsetbeachclub.es details below the general contracting conditions for the services offered through the establishment and from which, the rights and obligations of the parties are generated.

These General Conditions of Contract (hereafter "Conditions") have by regular function the relationship between SUNSET BEACH CLUB, S.A. (hereafter the "Provider") and customers (hereafter the "User"), relating to all transactions made through this website.

2º.2.- The User:
The user or client will be known as the Internet user who acquires this condition, by registering themselves on the website, using a form and assigned a username and password, of which they have full responsibility of use and custody, being responsible for the veracity of the personal data provided to the provider, as we will see in the User registration section.
3º.- Acceptance
By accepting these Conditions, the User declares:
That they are a person with the capacity to contract according to current regulations.
That they have read and accept these Conditions.
4º.- Availability:
The User will always have access and in any case, prior to the start of the procedure of contracting services, to the conditions, which may be stored and/or played on a durable medium.
5º.- Validity or Duration
The period of validity or duration of these Conditions and particular contract conditions, will be the time that they remain published on the website mentioned and will be applicable from the moment the User makes use of the website, and/or proceeds to contract any service offered.
6º.- Modifications
The Provider reserves the right to unilaterally modify said Conditions, without affecting the goods or promotions that were previously acquired before any modification by the User.
The User is committed to carefully reading the contracting conditions, each time they proceed with the contracting of a product given that they have been subject to modification since the last time it was accessed.
7º.- Nullity
If any clause included in these Conditions were declared totally or partially null or ineffective, such nullity will affect only said provision or the part that is null or ineffective, subsisting in everything else the Conditions.
8º.- Object of the contract
The purpose of this contract is to regulate the contractual relationship of the reservation born between the provider and the user at the time the user accepts the purchase during the online contracting process through the mechanisms listed below.
Each of the services offered may be subject to specific regulations through the particular contracting conditions of each one, of which more details will be given in the section about guarantees, returns, withdrawals, or in the technical sheet of the service, due to the different formats in which it is commercialized or by its own nature.
9º.- User Registration
The user will not be obliged to previously register on the web in order to carry out the booking.
SUNSET BEACH CLUB, S.A. offers the possibility of creating a user account in the reservation process allowing, in subsequent reservations, not having to re-enter your personal data again.
To do this, the customer in the "Finish purchase" step and before confirming the reservation, may create an account by clicking the “Create new account” button and enter a password. Additionally, in order to be able to recover the password, a question and an answer will be requested to add security to the account. This information is mandatory.
10º.- Geographical scope
This website www.sunsetbeachclub.es operates and sells in national and International territory. Here on, this geographical area will be understood as "the Territory". The use of this website as well as any reservation made on it is considered
carried out in Spain, and therefore subject to current Spanish laws and regulations.
All of the above is indicated without prejudice to the fact that soon we will be able to offer these services in the areas excluded, in which case it will be announced in advance on this website.
11º.- Services Information
The Provider pays great attention to the information regarding the characteristics of the apartments through technical descriptions and photographs that illustrate the rooms and additional services. All this is done within the technical limits and
respecting market standards.
12º.- Taxes, currency and shipping costs
The prices indicated for each product include Tax (VAT) and will be expressed in Euros (€).
13º.- Language in which the contract is developed
The contracting procedure and pre-contractual information is in Spanish and this language will be the one used to carry out the contract. Also, it offers the possibility of contracting in English indicating it before starting said process.
Steps of the Contracting / Reservation Process.
14º.1.- Registration
The user will not be obliged to previously register on the web in order to carry out the booking.
SUNSET BEACH CLUB, S.A. offers the possibility of creating an account allowing the customer to make a reservation again without having to input their data again.
14º.2.- Reservation process.
The client will choose the type of apartment and number of people. The next step will lead the customer to the possibility of selecting an additional package or service suggested, being able to omit this option at any time. The selection of the package or additional service will be included in the price of the reservation. In the last step, the customer will have to enter their personal data marked as mandatory.

You will not have to insert your personal data again if you have already made a reservation and created a user account. To do this, you will need to enter the e-mail and password with which you created the account in the space enabled for it.
Details of the necessary steps to make a reservation:
Selection of dates and availability.
To check availability you will have to select an arrival date, date of departure, number of nights, number of people (a difference will be made between adults and children, understanding children as those between 3 and 12 years old), optionally include a PROMOCODE, and click on “Check availability” or “See availability"
Rates and rooms.
Once the availability has been verified, a list will appear with the different rooms and rates available for the dates indicated. In this listing, additionally, rooms may appear with a promotional rate and better rate.
To obtain more information and view more photographs of the rooms you will have to click on “See more” and “See more photos” respectively. You can also view the breakdown of the price of the room by clicking on "View breakdown of price".
There is the possibility to compare rooms. To select the chosen room, click on the “SELECT OR CHOOSE” button.
Select the Packages.
Additionally, you can choose one or several suggested packages for your reservation. For information on each item you will need to click on the title of the package. Once the package or packages have been selected, through the “ADD ITEM”, you will have to click on “SELECT PACKAGES” for them to be included in your reservation. Otherwise, click the “NO, THANKS” button to not add any.
The price does not include taxes and fees.
Checkout.
In this step you will have to indicate your personal data, marked as required, to finalize the reservation.
4.1.- Personal information.

In this section you can create a user account by clicking on “Create new account” and enter a strong password. It is also necessary to enter a security question with an answer to be able to retrieve the password in case you forget.
To make future reservations, without having to re-enter your data, you will have indicate your email address and password in the section “Data recovery of registered users”.

You will need to select an available payment method from the list and enter the data marked as required.

4.4.- Additional details.
This section is optional and you can indicate an additional comment for your booking: indicate your arrival and departure to be able to prepare a warm welcome, and to receive promotions and special offers.
In order to finalize a reservation, you will have to accept the reservation regulations clicking on “Please specify that you have read and understand the privacy policy fares on your itinerary. Then click on "CONFIRM RESERVATION"
Review.
Click on the “CHECK MY RESERVATION” button to access the summary and verify that all data is correct before confirming the reservation. On this screen, once the data has been verified, you can modify the data by clicking on “MODIFY
RESERVATION” or confirm the reservation by clicking on “CONFIRM RESERVATION”.
Confirmation.
Once the reservation is confirmed, it will direct you to a new screen where it will show a summary with all the details of the reservation along with the confirmation number or booking. At the same time, you will receive a confirmation e-mail with the summary of the reservation to the email account that you indicated.
Provisions to consider during the purchasing process.
15º.- Availability of the service
The reservation of the offered apartments is subject to availability. In the case that there aren’t any available apartments, the user will not be able to select the desired apartment for the indicated dates.
16º.- Types of apartments
The website has a wide variety of tourist services, reservations of apartments, contracting events and weddings at very competitive prices, distributed into categories for an easy search.
17º.- Maximum order amount
The maximum order will be 9 rooms.
18º.- How to modify or cancel my reservation
To modify a reservation you can do so by entering the website
www.sunsetbeachclub.com, by clicking on the button Bookings, Modify/Cancel.
Reservations can be cancelled free of charge as long as the following conditions are met*:
- May, September & October: cancellation is made a minimum of 7 days before arrival
- June, July & August: cancellation is made a minimum of 14 days before arrival
- Winter (from November to April): cancellation is made a minimum of 48 hours before arrival
After the cancellation of the reservation, the corresponding amount will be charged according to previous conditions to the credit/debit card from which the reservation was made. If the card is not operational SUNSET BEACH CLUB, S.A. will contact the client to ask for their new data.
*Please note that different Conditions may apply for special offers/tariffs, pre-paid tariffs, Promo Code bookings, and for groups or package rates. The Booking Conditions for your own booking will be on your Email Confirmation.
19º.- Invoice
Where can I check my invoice? The invoice will be handed to the guest upon arrival after payment. However, at the time of making the reservation, the client will receive an email confirmation message detailing the price of the accommodation.
20º.- Value Added Tax
In accordance with current regulations, any purchase made through the website will be subject to tax: IVA (VAT)
21º.- Payment methods
In general, payment will be made when the client arrives at the hotel. The introduction of the payment method in the reservation process will not mean that the payment is made immediately, it will only be a way to guarantee the reservation.
A reservation will be charged if the cancellation conditions indicated in section 18 are breached.
22º.- General provisions on the Payment Process
The payment order given by the User implies adherence to the General Conditions as well as the particular conditions of the reservation. Once the reservation is made, the User will receive an email confirming the essential conditions of the operation:
-Contracted services, and description of the provision. In any case, the User will always have the information of their reservation in the confirmation e-mail they received. The Provider reserves the right to cancel payments or orders if there are indications of fraudulent operations by informing the authorities of conducts that are susceptible to investigation for the prevention of fraud.
23º.- Withdrawal
According to the regulatory regulations, the right of withdrawal from the contracted service SUNSET BEACH CLUB, S.A. It is reflected in section 18.
24º.- Customer service: Help, Suggestions and Claims
You can contact our Customer Service at any time to ask for help, make suggestions or complaints by writing to info@sunsetbeachclub.com, or by calling 952579400, available 24 hours a day.
25º.- Guarantee of the products.
The guarantee of this product corresponds to the effective service and enjoyment of the stay in the selected apartment, for the number of people selected and under the conditions of use that are specified in the e-mail of confirmation received after booking.
26º.- Rights of the Provider
- Preserve, modify or suspend your website without prior notice.
- Modify the price of the offers.
- Refuse access to computer tools to clients in case of breach of these conditions.
- Do not reproduce, alienate, or dispose of the information published by The Provider in all its contents without the express permission of the company itself.
- Proceed to correct or amend human or computer errors.
27º.- Limitation of liability
All the information provided by the User to the Provider and through the corresponding forms must be correct. It is the responsibility of the User to keep the data supplied, to the Provider, duly updated. In any case, the Provider disclaims any liability for damages or losses caused as consequence of having provided false, insufficient, inaccurate, or incorrect information. Access to the website does not imply any obligation on the part of the Provider to verify the authenticity, suitability, completeness, accuracy, adequacy and updating of the information provided by the User through the corresponding forms.
The Provider will not be responsible in those cases in which it corresponds to the parents, guardians, or legal representatives of minor Users or disabled guests, authorize access, provision of personal information or use of the website or the contracting of any products or services provided through applications or web platform. It will be the responsibility of the aforementioned parents, guardians or legal representatives to supervise the access and use of the minors or www.sunsetbeachclub.com
The access of the Users to the Contents does not imply any obligation on the part of the Provider to control the absence of viruses or computer elements that may have any harmful effect on the User's computer equipment. In any case, it will correspond to the User to have the necessary tools to detect said viruses or malicious software. Consequently, the provider will not be responsible for possible damage caused to the computer equipment of Users or third parties during access to the Contents.
The Provider will not be liable for interruptions that occur in the services electrical or telecommunications that prevent users from using the services offered.
28º.- Applicable Law and Jurisdiction
These conditions will be governed or interpreted in accordance with Spanish legislation for items that are not expressly stated. The provider and the user agree to submit any dispute that may arise from the provision of products or services subject of these Conditions, to the Courts and Tribunals of the user's address. In the event that the user’s residence is outside of Spain, the provider and the user, expressly waive any other forum, submitting to the Courts and Tribunals of the address belonging to THE OWNER OF THE WEB.
